An elder law attorney in San Ramon may charge a flat fee for defined planning services or an hourly rate for matters that are harder to predict. Routine documents may cost a few thousand dollars, while long-term care planning, conservatorships, and urgent Medi-Cal matters can cost substantially more. Your final fee will depend on the work required, your family’s circumstances, and whether the attorney must resolve an immediate problem.

How Much Can an Elder Law Attorney Cost in San Ramon?

There is no standard price for elder law services in San Ramon or elsewhere in California. Published California pricing commonly places attorney hourly rates between approximately $250 and $500. Flat fees for wills, powers of attorney, and relatively straightforward trusts may range from about $1,500 to $6,000.

Comprehensive or time-sensitive planning can cost $5,000 to $12,000 or more. These figures are broad estimates rather than quotes, and Bay Area rates may differ from those charged elsewhere in California.

When comparing fees, ask what the quoted price includes. Some quotes may not cover later revisions, deed preparation, filing costs, or follow-up assistance. California law generally requires a written fee agreement for noncontingent legal matters when the attorney reasonably expects the client’s total fees and costs to exceed $1,000, although limited exceptions apply. The agreement should explain how the fee is calculated, the general scope of the legal services, and the responsibilities of both the attorney and the client.

Do Elder Law Attorneys Charge Flat Fees or Hourly Rates?

The billing method usually depends on whether the scope of the work can be determined in advance.

A flat fee is common for services such as:

  • Preparing a will or revocable living trust
  • Drafting a durable power of attorney
  • Creating an advance health care directive
  • Reviewing and updating an existing estate plan

Hourly billing may be more appropriate when the attorney cannot predict how much work the matter will require. Examples include contested conservatorships, complex trust administration, family disagreements, and urgent long-term care planning.

Some firms use a combination of the two. An attorney might charge a flat fee for preparing documents, then bill hourly if additional issues arise outside the original agreement.

How Does Horizon Elder Law & Estate Planning Set Its Fees?

For estate planning services, we quote a fixed fee after meeting with you and evaluating your circumstances and planning needs. We provide that amount in writing, so you know the cost before deciding whether to proceed.

We do not begin the work until you provide written consent and the agreed deposit. If you later request changes or additional planning, we will review the work involved and provide another written fixed-fee quote.

What Factors Affect Elder Law Attorney Fees?

Two families requesting “an estate plan” may need very different levels of legal work. An attorney will often consider:

  • The number and type of documents required
  • Whether you own a business or property in multiple states
  • The size and structure of your estate
  • Potential family disputes or concerns about financial abuse
  • Planning for a beneficiary with a disability
  • Medi-Cal eligibility and long-term care needs
  • Whether immediate action is required because of illness or incapacity

Cost may also increase when an attorney must coordinate with financial advisers, care managers, accountants, or other professionals. If an older adult can no longer sign legal documents, the available options may be more limited and require court involvement.

How Much Does Medi-Cal or Long-Term Care Planning Cost?

Medi-Cal and long-term care planning may cost more than preparing a basic will because it can require a broader review of your finances, property, care needs, and eligibility options.

Starting before a health crisis may reduce the amount of urgent legal work required. It can also give you more time to consider available care and financial planning options. If a family member is already entering a nursing facility, tell the attorney when scheduling the consultation so the firm can assess the timing.
